Part 1 : Interpretation
1.5 Language
1.5(1)
In this bylaw:
- (a) words in singular include the plural and words in the plural include the singular, where the context requires;
- (b) words used in the present tense include the other tenses and derivative forms;
- (c) "shall", "must", and "required" are to be construed as a compulsory obligation; subject to the variance provisions of this bylaw;
- (d) "may" is to be interpreted as meaning that a choice is available, with no particular direction or guidance intended;
- (e) "should" is an operative word which means that, in order to achieve municipal goals and objectives, it is strongly advised that the action be taken. Exceptions may be made only under extenuating circumstances;
- (f) "despite" or "notwithstanding" indicates that a particular clause takes precedence over another, even if the other clause might contradict.
- (g) "includes" before a list means that the list is exhaustive, i.e., all the possibilities are explicitly identified in the list.
- (h) "including but not limited to", "includes but is not limited to" or "include but are not limited to" before a list means that the list is not exhaustive but is meant to provide examples and guidance without being binding.
- (i) "may include" before an item or a list allows for that item(s) to be included, but does not require it.
- (j) words, phrases, and terms not defined in this section of the Bylaw may be given their definition in the Municipal Government Act or Municipal Development Plan. Other words shall be given their usual and customary meaning;
- (k) a "person" includes an individual, partnership, association, corporation, firm, trustee, executor, administrator and legal representative of a person; and
- (l) an "individual" does not include a corporation or other types of persons who are not human beings.
- (m) where there is a regulation that applies generally, and a similar regulation that applies in a more specific scenario, the latter regulation shall apply.
