Part 13 : Overlays

13.1  AO – Airport Vicinity Overlay

Purpose

13.1(1)

To regulate development in the area surrounding airports as identified within Schedule A of this bylaw to prevent conflicts between the airport and surrounding land use or development.

Uses

13.1(2)

Despite the permitted and discretionary uses in the underlying zone, a proposed development on land located within the AO shall not result in conditions that would create conflict with airport or aircraft operations by reason of:

  1. (a) discharge of toxic, noxious or other particulate matter into the atmosphere;
  2. (b) radiation or interference with navigational signals or radio communications caused by the use of electronic equipment such as industrial X-ray, diathermy equipment, or equipment for commercial purposes;
  3. (c) creation of fire and explosive hazards;
  4. (d) accumulation of any material attractive to birds; or
  5. (e) creation of glare or lighting that interferes with lights necessary for takeoff or landing of aircraft.

Subdivision Regulations

13.1(3)

Subdivision must comply with the regulations of the underlying zone.

Development Regulations

13.1(4)

Development must comply with the regulations of the underlying zone.

13.1(5)

Despite section 13.1(4), the maximum height of any development including all appurtenances and any temporary construction equipment shall be 10 m.

13.1(6)

Despite section 13.1(5), the maximum height regulation may be varied if an aeronautical study prepared by a qualified professional is submitted that determines that the variance would not adversely affect safety and the applicable airport authority provides consent.
