15.65  DC 77 Direct Control zone

DC 77 DIRECT CONTROL ZONE

15.65(1)

Purpose

To establish a site specific Direct Control zone to accommodate a broad range of agriculture-related businesses on rural unserviced land along a major transportation route with good visibility and accessibility, pursuant to the Conceptual Scheme for SE15-53-22 W4.

Area of Application

This zone shall apply to a portion of SE 15-53-22 W4, as shown on the above map.

Uses

15.65(3.1)

Area A

The purpose of Area “A” is to respect the existing single dwelling and to contemplate limited agri-business uses that are less intensive than those found in Area “B”. Development in Area “A” should not cause nuisances beyond its boundaries and serve as a transition to surrounding land uses.

(a) It is a fundamental use criterion that the whole quarter section will contain no more than eight (8) developable parcels and that the maximum number of developable parcels in Area “A” shall be one (1).

Area B

The purpose of Area “B” is to allow for the development of agricultural businesses intended to provide value-added services to the agricultural industry.

  1. (a) It is a fundamental use criterion that:
    1. (i) the whole quarter section will contain no more than eight (8) developable parcels and that the maximum number of developable parcels in Area “B” shall be one (1);
    2. (ii) an equipment, major use in Area “B” is restricted to agricultural related equipment only.

  Subdivision Regulations

  1. (a) The minimum lot area is 2.0 ha.

  Development Regulations

  1. (a) The maximum height is 12 m, except for agricultural structures.
  2. (b) The minimum front yard is 10 m.
  3. (c) The minimum side yard is 6 m.
  4. (d) The minimum rear yard is 10 m.

  Other Regulations

  1. (a) Development within this zone shall be in accordance with the following design standards, to the satisfaction of the development officer:
    1. (i) The exterior design and finishing materials of the buildings shall incorporate architectural features and elements that are characteristic of the rural/agricultural setting of the zone;
    2. (ii) Outdoor display areas and outdoor service areas, including loading and/or vehicular service areas which are visible from an adjacent public road shall be suitably screened with fencing, berming and/or landscaped screen planting; and
    3. (iii) Landscaping within any setback from a road right-of-way shall be include a minimum of one tree placed along each 10m of linear frontage. Deciduous trees shall have a minimum 60 mm caliper and coniferous trees shall be a minimum of 2.5 m in height.
  2. (b) In addition to the regulations above, the listed uses are subject to the applicable regulations contained within the Land Use Bylaw, unless such regulation is specifically excluded or modified by the Direct Control zone.
15.65(7)

  Development Permits

  1. (a) A development officer shall consider and decide upon all development permit applications within this zone.
