Part 16 : Centre in the Park Zone

16.14  TM – The Market

Area of Application

16.14(1)

The TM area contains the area of land identified as "TM" on 16.1(66) Drawing "CITP". The regulations set out in this section 16.14 apply to the TM area.

Purpose

16.14(2)

The purpose of this area is to provide for a range of commercial uses that help to define the Urban Centre and that service Sherwood Park and beyond. The area includes a pedestrian linkage between the northern Festival Way/Sherwood Drive intersection and the Urban Square.

Subject to any fundamental use criteria for certain uses set out below, the permitted uses and the discretionary uses for this zone are listed in Table 16.14(A).

Fundamental Use Criteria

16.14(4)

The fundamental use criteria for certain uses before uses become permitted or discretionary uses within this zone are:

  1. (a) Dwelling, apartment shall only be considered where it is not located on the first storey of a building.
  2. (b) Retail, alcohol shall only be considered where it does not front onto Festival Way.

Development must comply with Table 16.14(B). Figure “TM” provides a visual representation of some of the following provisions.

16.14(6)

A development shall provide the active transportation infrastructure connections shown on Drawing "TM" or alternative linkages on the same site to the satisfaction of the development officer.

Other development regulations

16.14(7)

Wheel stops shall be provided within every parking space located along the central pathway.

16.14(8)

Additional signage shall be provided along the central pathway indicating “No Backing into Spaces Allowed”.

16.14(9)

The central pathway shall be designed to incorporate 1.0 m2 of planting beds for every 15.0 m2 of pathway. The required planting beds are to be consolidated into openings of a minimum of 3.0 m2 containing perennials and/or shrubs with at least one (1) tree per bed. A minimum of one (1) bench for each twenty (20) lineal meters of pathway shall be provided.

16.14(10)

Parking layouts and space locations shall be coordinated with the County to ensure that vehicles do not encroach on the central pathway when entering or leaving a parking space.

16.14(11)

Development that includes a storefront along Festival Avenue or the Urban Square must have storefront glazing using glass and spandrel panels.

16.14(12)

Development that includes a commercial retail bay along Festival Avenue or Sherwood Drive must have single doors to that commercial retail bay. Doors located adjacent to the Urban Square shall be Handicap accessible doors. Double entry doors may be provided to each commercial retail bay facing the Urban Square.

16.14(13)

Development that includes building facades along Festival Avenue, Sherwood Drive and the Urban Square shall incorporate a combination of solid walls and storefront glazing and entrances. Solid up stand walls required to accommodate established Festival Avenue grades shall be minimized with landscape features and treatment.

16.14(14)

The 4.8 m wide, active transportation infrastructure connection, identified on Drawing "TM", shall not be occupied by anything other than a landscaped pathway linking the Urban Square and the northern intersection of Festival Way and Sherwood Drive.
