2.4 Development authority and development officer
Establishment
The development authority is established.
The Director of Planning & Development Services (“the Director”) constitutes the development authority for the County and shall perform duties in accordance with the Municipal Government Act, the Matters Related to Subdivision and Development Regulation and this bylaw.
For administration of this bylaw, the Director may delegate responsibility to:
- (a) any County employee designated as the development officer; or
- (b) any other person specifically delegated in writing as having the authority to make a decision on development permit applications.
Powers and duties
The development authority shall exercise development powers and perform duties on behalf of the County as set out in this bylaw and in accordance with the Municipal Government Act.
The development authority may enforce the provisions of this bylaw.
Subject to any legislation restricting availability, the development authority will make available for inspection by any person during normal business hours of the County the following:
- (a) a copy of this bylaw;
- (b) a register of all complete applications for a development permit; and
- (c) a copy of all decisions for an application for a development permit and all issued development permits.
Where a proposed development that is the subject of an application for a development permit generally conforms to the wording of two or more uses, the development authority shall determine which use is applicable based on the use that fits closest to the proposed development's character and purpose.
