3.9 Maintenance easements for residential development
At the time of subdivision, a lot for a single dwelling with one setback from a side lot line of 0.0 m shall require a minimum 1.5 m wide easement be registered on title of the lot abutting the zero lot line that provides for:
- (a) a 0.30 m eave encroachment with the requirement that the eaves of the principal dwelling and the eaves of any accessory building(s) shall be a minimum 0.90 m to the eaves of any building(s) on the abutting lot; or
- (b) eave and/or gutter encroachment;
- (c) a 0.60 m footing encroachment;
- (d) drainage in accordance with County bylaws and standards;
- (e) permission to access the easement area for maintenance of both lots; and
- (f) any other items necessary to facilitate the intended development.
Despite section 3.9(1), in the R1B, R1C, R2A and R3 zones, a lot for a single dwelling with one setback from a side lot line of 0.0 m shall require a minimum 2.4 m wide easement be registered on title of the lot abutting the zero lot line.
At the time of subdivision, a lot for a single dwelling with one setback from a side lot line reduced to 0.6 m shall require a minimum 1.5 m wide easement be registered on title of the lot abutting the zero lot line that provides for:
- (a) a 0.30 m eave encroachment with the requirement that the eaves of the principal dwelling and the eaves of any accessory building(s) shall be a minimum 0.90 m to the eaves of any building(s) on the abutting lot; or
- (b) eave and/or gutter encroachment;
- (c) drainage in accordance with County bylaws and standards; and
- (d) permission to access the easement area for maintenance of both lots.
Side door access for lots with one side setback of 0.0 m and a 1.5 m private maintenance easement shall not be more than 0.6 m (60 cm) above the finished ground surface.
